Will and declaration in acts performed by intelligent software agents – preliminary issues on the question

چکیده
The use of intelligent software agents in electronic commerce brings along new issues in Civil Law. These new kind of agents will enact declarations of will and agreements on their own, without the individual (human) being aware that contract negotiation has been initiated, or concluded. This will force us in the end to analyze the possibilities of applying the general civil law rules on divergences between will and declaration and also on defects of will to the contractual declarations enacted by intelligent software agents.
